TERM AND CONDITIONS
You are encouraged to carefully review the full text of our Information & Conditions. Payment of deposit and/or final payment are an acknowledgement of receipt of these information & conditions and constitutes acceptance of such as outlined.

Deposit
Please complete and forward the Agreement Form accompanied by a non-refundable deposit of $250 per person and a copy of your passport to Maxima Travel or Gutsy Lady Travel at the time of booking. Certain tours and arrangements will require a higher deposit. The exact amount will be advised at the time of booking. 

Reservation Changes
Changes to an existing reservation, whatever the cause, will incur $50 per person plus any additional supplier fees. This includes name changes* and removal of any services such as optional tours and transfers. 

*Please note that name changes to airline reservations are subject to full cancellation and rebooking. 
Changes or additions after departure are subject to local rates at the time of amendment and must be paid directly by the passenger to the service provider. There are no refunds for unused services.

(Maxima Travel reserves the right to correct any errors in rates quoted or calculated, or any omissions made at any time during your booking. Any verbal quote given is an indication only of the final price and is subject to confirmation in writing.)

Receipt of Deposit
Receipt of a deposit will be taken as an understanding by Maxima Travel or Gutsy Lady Travel that the customer has read, signed an Agreement to be bound by the Terms and Conditions.

Form of Payment
Canadian dollar cheque, bank cheque, money order, wire transfer, and major credit cards. Credit card charges will be accepted by phone to fulfill non-refundable deposit requirement. Final payment will be processed upon submission of a completed Maxima Travel or Gutsy Lady Travel Credit Card Form. Third-party credit cards are not acceptable. All payments made within 30 days of departure must be in the form of a certified cheque payable to Maxima Travel, money order, or credit card; certified cheques and money orders should be delivered to Maxima Travel no later than 3 days following the reservation. Payment made by credit card are subject to a 3% surcharge. Payments made by wire transfer must include an additional $25 wire transfer fee. There is a $50 fee for returned cheques.

Balance of Payment
The final balance of the travel arrangements is due at Maxima Travel no later than 80 days prior to the chosen tour departure date. Certain tours and arrangements will require an early balance due date. Available methods of payment are credit card, cheque, cash, direct deposit or money transfer. A 3% surcharge applies for certain tours if paid by credit card. Balance due date and methods of payment will be advised at the time of booking.

Late Payment
If there is any outstanding balance by the Final Payment Due date listed on your invoice, all travel services will be subject to automatic cancellation. A service reinstatement fee of $50 will be added to your invoice and must be paid in advance in order to apply for reconfirmation of services.

Air-inclusive Package Payment
In addition to paying the deposit amount, for air-inclusive packages, additional payment may be required for international flights before the final balance due date. Full air payment is required at the time of issuing the flight tickets. Any cancellation or changes to the flight schedule will result in airline penalties at your own expense.

Fees & Charges
All air-inclusive prices are based on group travel and any deviation from the set itinerary may incur additional airline ticket costs (Breakaway Fee). Arrangements such as transfers, accommodation, etc., outside the set group arrangements/dates are at an additional cost and are not covered by the 
Breakaway Fee.

Amendment & Booking Fees
If you vary your booking, other than by transferring your tour package, tour departure date or name transfers, an amendment fee of $50.00 applies.
 Amendments made within 80 days or less before the tour date of departure will incur heavy penalties. 

Transferring between tours (81 days or more) incurs a $100 per person administration fee. Transfer fees must be paid at the time of change. 
Transferring between tours within 80 days or less of the tour departure date will be regarded as a cancellation. 

Reissue of airline tickets - from $300 per person (other fees may apply). 

Once a booking is confirmed, name transfers are not permitted as this will be regarded as a cancellation.

Cancellation by Customer
All cancellations must be made in writing to Maxima Travel and will be subject to the following cancellation charges from the date the written cancellation is received: 

  1. More than 80 days prior to departure; loss of deposit plus any administration fees (includes credit card fees, airline cancellation fees and any applicable amendment fees).
  2. Between 79-40 days prior to departure; 50% of land tour cost plus any administration fees (includes credit card fees, airline cancellation fees and any applicable amendment fees).
  3. Between 39-20 days prior to departure; 75% of land tour cost plus any administration fees (includes credit card fees, airline cancellation fees and any applicable amendment fees).
  4. 19 days or less prior to departure; 100% of total tour cost.
The land tour cost can be found in the brochure/on the website. Regrettably cancellation charges and fees cannot be waived. There can be no exceptions. No refund will be made for any unused portions of the holiday after the departure date. 

Please note that employees of any overseas company or staff of Maxima Travel outside Canada are not authorized to give any guarantees or agreements to customers in respect of refunds or any other matters.

Cancellation Policy
Maxima Travel or Gutsy Lady Travel reserves the right to cancel or vary a tour prior to departure due to insufficient numbers. In such an event, alternative guaranteed travel dates will be offered. Should these options not be acceptable,Maxima Travel or Gutsy Lady Travel will refund the full price paid. If a tour is cancelled due to unforeseeable circumstances such as, but not restricted to, severe weather conditions or force majeure, Maxima Travelwill refund all monies and any cancellation fees levied by airlines and other third parties. Unforeseeable circumstances such as force majeure, adverse weather, flight rescheduling, hotel overbooking and faults with transportation or road conditions may also have an effect on the tour itinerary after the commencement date. Any decision made in respect of tour services by independent operators to re-route or amend the itinerary due to any of the above or similar circumstances is at the discretion of the tour service provider and Maxima Travel or Gutsy Lady Travel shall not be liable for any claim arising from such events.

Refusal of Carriage
Maxima Travel or Gutsy Lady Travel retains the right to remove customers from our group for reasons that impact on the enjoyment or safety of other tour members, such as, but not limited to, the physical, medical or mental inability of customers to undertake the arrangements of the tour; unsocial or unruly behavior;committing or attempting to commit an illegal act or criminal act;the carriage of prohibited substance abuse or overdose, alcohol abuse, or alcoholism.All expenses to do so will be borne by the passenger.

Hotel Descriptions, Maps & Pictures
Any hotel descriptions are based on current hotel guides provided by suppliers and contractual agreements. Any facilities described are subject to change at any time. Maps and photographs are included for general information only and may not necessarily reflect actual routings, location or services. Maxima Travel or Gutsy Lady Travel has made reasonable enquiries to verify that the descriptions and details are accurate but does not warrant that they are.

Travel Insurance
Maxima Travel and Gutsy Lady Travel strongly recommends that all customers be adequately covered by insurance including coverage for Trip Cancellation, Interruption, Baggage Loss or Delay, Medical Expenses for the duration of their travel arrangements. Maxima Travel or Gutsy Lady Travel cannot be made liable for any cost incurred by the customer on any tour if not adequately insured.

Health Requirements
All customers must possess physical and mental fitness well enough to travel and are required to familiarize themselves with any health requirements specific to the countries being visited. Customers with a pre-existing medical condition that affects their fitness to travel, or any medical/dietary requirements must advise Maxima Travel or Gutsy Lady Travel when booking their tour and may be required to provide written confirmation from their doctor that they are fit to travel. All customers should visit their doctor to confirm that they are physically able to undertake the day-to-day requirements of the tour. Should any ailments either exist at the time of booking, or arise before their departure from Canada, the customer must inform Maxima Travel or Gutsy Lady Travel of this in writing.

Baggage & Personal Effects
The standard check-in baggage allowance for most airlines is limited to one piece and must not exceed 20 KG and carry-on baggage is limited to one piece and must not exceed 7 KG. Baggage allowance is subject to airline policies.Maxima Travel or Gutsy Lady Travel will not be responsible for loss or damage to luggage and personal belongings including for loss or damage to money, jewelry, collector’s items, negotiable papers, business documents, eyeglasses, cameras, electronic or computer equipment, photographic equipment, medications, damage to inadequately packaged/overstuffed checked items, and loss or damage of any items packed in such containers or bags; all electronic hardware, software and peripherals; cosmetics, toiletries and personal hygiene products; medications and medical equipment. You MUST report any loss or damage immediately at the time of the incident and obtain a written report from the local authority for submission to your insurance provider. If your luggage is lost or damaged by the airlines, a baggage claim form MUST be filed with the carrier before leaving the airport. Many airlines apply charges for checked bags. Please check your airline for a complete list of fees. Maxima Travel and Gutsy Lady Travel are not responsible for checked bag fees, excess luggage or weight charges levied by an airline.

Travel Documents
Passengers are responsible for ensuring that they have the proper travel documents and MUST CHECK with the respective consulate(s) or visa agency to determine whether any visas or passports are required. Passports are required to be valid for at least 6 months after the date of travel. Any information provided by Maxima Travel or Gutsy Lady Travel pertains to Canadian citizens only. Non-Canadian citizens should check with the respective consulate of the country(s) to be visited for current entry requirements. Visa costs are not included in tour packages unless otherwise explicitly stated. Responsibility for documentation accuracy, passport validity and dispatch of documents rests with the customer. Maxima Travel or Gutsy Lady Travel accepts no responsibility for any failure in this respect. 

A passport with a minimum of six months validity is required for customers travelling to all countries in our programme. Non-Canadian passport holders will incur additional fees. Visa costs are not included in tour packages unless otherwise explicitly stated. If passports are not received by Maxima Travel or Gutsy Lady Travel 60 days prior to departure, at the specified time the customer may be required to pay an urgent visa processing fee. Responsibility for documentation accuracy, passport validity and dispatch of documents rests with the customer. Maxima Travel or Gutsy Lady Travel accepts no responsibility for any failure in this respect.

Hotel Accommodations
All rooms are stated in the travel package unless you have specifically requested and paid for an upgraded room category. Maxima Travel or Gutsy Lady Travel reserves the right to make substitutions with hotels of equal standard. There will be no refunds for any difference in the cost of those accommodations. Special requests such as bed types, smoking preference and connecting rooms are subject to availability.

Single Travelers
If travelling alone a single supplement surcharge will apply unless specified in the itinerary. Single supplement fees are also applicable for any rail or cruise components and cannot be waived.

Tipping
Tipping is expected element in the tourism industry today. Tipping can be pre-paid in Canadian dollars prior to your departure date. The amount payable for each tour is shown in the tour descriptions and Maxima Travel or Gutsy Lady Travel will advise the exact amount required per person at the time of booking. Tipping amounts are based on the tour itinerary and length and are subject to change.

Shopping
Maxima Travel or Gutsy Lady Travel and its employees are not qualified nor permitted to ensure or guarantee the quality or value of any goods purchased or the suitability of any retail outlets visited. In all cases the purchasing of goods and the use of a credit card for those transactions is entirely at the customer’s own risk and at all times the customer must use their own discretion.

Responsibility
Maxima Travel or Gutsy Lady Travel acts as a co-ordinator for all persons taking these tours in the making of all arrangements for transportation, sightseeing and hotel accommodation. 

Maxima Travel or Gutsy Lady Travel does not own, manage, control or operate any transportation vehicle, any hotel or restaurant or any other supplier of services. All coupons, receipts and tickets are issued subject to the terms and conditions specified by the supplier and all services are subject to the laws of the country where the services are provided. Maxima Travel or Gutsy Lady Travel acts only as an agent for the owners, contractors and suppliers provided and assumes no responsibility for the loss or damage to baggage or property or for any injury, illness or death or for any damages or claims whatsoever caused arising directly or indirectly from accidents, loss or damage to person or property, delays, transport failure, strikes, wars and uprisings or acts of God etc. over which Maxima Travel or Gutsy Lady Travel has no control.

Customer Service
At Maxima Travel and Gutsy Lady Travel, we are committed to ensuring that we deal with complaints effectively and efficiently. Should the customer not be satisfied with any aspect of their travel arrangements they must immediately inform the National Escort or local guide who will endeavour to resolve the issue at the time. There will be no refunds for unused package tour services or features, including missed transfers due to airline changes and/or missed flights, unused meals, missed sightseeing tours, unused entrance fees, and accommodations. Airline flight cancellations and delays for any reason are not the responsibility of Maxima Travel and Gutsy Lady Travel. Submit your claim directly to the airline. Complaints regarding a hotel's standards or amenities should be addressed directly with the hotel's management.

If you wish to lodge a complaint or claim regarding the booking or arrangement of travel services,this must be done in writing to Maxima Travel in Canada within 30 days of the date of the completion of your Maxima Travel or Gutsy Lady Travel arrangements. Relevant receipts and substantiating evidence must be attached to the letter of claim.

If you wish to lodge a complaint or claim regarding the consultation of travel by Gutsy Lady Travel, this must be done in writing to Gutsy Lady Travel in Canada within 30 days of the date of the completion of your Lady Travel arrangements. Relevant receipts and substantiating evidence must be attached to the letter of claim.

Refunds are processed to the credit card(s) originally used for payment, up to the total amount paid, with any remaining balance paid by Canadian dollar cheque. These terms may not be changed by anyone other than an authorized representative of Maxima Travel and must be documented in writing. Maxima Travel is not obliged to guarantee promises (written or verbal) made by local hotel staff, tour guides, or any other persons not under direct employ of Maxima Travel.

Limitation of Liability
Liability, if any, shall never exceed the amount actually paid to Maxima Travel.

Airlines
Airline schedules and flights are subject to change without notice. Maxima Travel and Gutsy Lady Travel are not responsible for penalties incurred for tickets, international or domestic flights due to schedule and/or flight changes. If deem it necessary, may be rebooked to match minimum connecting time requirements and/or tour package itineraries, in which case you will be notified immediately. Airlines reserve the right to demand immediate issuance of tickets whenever they determine that specific flights are heavily booked even when normal ticketing rules do not require tickets to be issued until a later date. In this instance, Maxima Travel or Gutsy Lady Travel will require immediate and full payment of the airfare as itemized on the invoice. This situation overrides invoice terms and conditions and payment due dates. If full payment is not received, seats will be cancelled by the airline and may not be available to be rebooked on the same flights or at the same airfare. Any replacement air arrangements and airfare will be the sole responsibility of the passenger. Frequent flyer miles may not be accrued on travel packages. 

(Airlines do not by virtue of their endorsement represent themselves either as contracting with any purchaser of a holiday from Maxima Travel or Gutsy Lady Travel or as having any legal relationship with such a purchaser. Frequent flyer miles may not be accrued on packaged fares.)

Airline Tickets
Once full payment is received, Maxima Travel and Gutsy Lady Travel airline tickets will be issued and are fully non-refundable. Should airline tickets require to be issued earlier than the Final Payment Due date, you may be required to pay a larger non-refundable deposit and/or complete full payment.

Airline Seat Assignments
As a courtesy service, airline seat assignments are requested on your behalf. Assignments reflect the best available seats at the time of booking. Some airlines and/or fare types do not allow for pre-seating and require this be done at airport check-in only; in this case, the display shows "N/A". Seats are subject to change by your airline(s) including, for example, when there is a schedule change or equipment

Contact Information
Pursuant to TSA Secure Flight requirements, passengers are responsible to provide Gutsy Lady Travel with their name as it appears on their passport (or other government-issued I.D. when traveling), date of birth, gender, address, phone number, and email for all passengers. Passengers must ensure that names are correctly listed on their invoice. Maxima Travel and/or Gutsy Lady Travel will not be responsible for passengers who do not receive an invoice or documents or are denied boarding due to inaccurate information. 

Airline Name Changes:
Any name change including minor spelling corrections may require airline reservations to be canceled and rebooked. Reservations are subject to current availability and pricing at the time of rebooking. Once airline tickets are issued, subsequent name corrections will be subject to an airline rebooking fee which may be as much as the full value of the airline ticket plus a $50 revision fee per change. Maxima Travel and Gutsy Lady Travel will not be held responsible for the denial of services by a carrier due to any name discrepancy. Name changes must be advised in writing.

Schedule Changes
In the event of an airline schedule change, Maxima Travel and Gutsy Lady Travel will make every effort to inform passengers of the schedule change and new flight schedule prior to departure. Maxima Travel and Gutsy Lady Travel is not responsible for schedule changes including, when applicable, changes in routing and/or the number of stops in the itinerary. Maxima Travel and Gutsy Lady Travel is unable to provide compensation for schedule changes, seat assignment modifications, or cancellations implemented by an airline. In the event of any change in flight itinerary made directly between passengers and their airline, it is the passengers' responsibility to advise Maxima Travel and Gutsy Lady Travel of amended flight details in writing. Maxima Travel and Gutsy Lady Travel cannot be held responsible for land services, including arrival and/or departure transfers, if flights are changed without its knowledge.

Addresses
By providing email and postal addresses on the Reservation Form, you have agreed to receive correspondence from Maxima Travel or Gutsy Lady Travel which may contain marketing, specials and promotional material.

Brochure Validity
Tour itineraries and prices in the brochure/on the website are accurate at the time of publishing and prices are based on exchange rates as of December of the previous year. Once a customer has paid in full, the price of the tour is guaranteed, subject to any tax changes or levies imposed by any government or their agencies or any airline. The prices for tours in the following year are subject to change without notice. Maxima Travel or Gutsy Lady Travel reserves the right to make alterations to itineraries, departure dates and prices due to circumstances beyond their control.

Agent Responsibilities
It is the travel agents’ responsibility to ensure that all invoice and itinerary details and documentation issued by Maxima Travel or Gutsy Lady Travel are correct and that the customer is aware of amendment and cancellation conditions and other clauses in the Booking Conditions.

Pricing
Prices are per person based upon shared twin room occupancy. Maxima Travel and/or Gutsy Lady Travel reserves the right to increase prices accordingly. Prices do not include items of a personal nature such as laundry, wines, water, beverages, food other than the table d'hote menu, passport and visa fees, insurance, and foreign port taxes unless specifically indicated in the package inclusions. Prices are correct at time of publication; however, as airfares continually fluctuate and classes of service may have limited capacity, tour package prices and availability will change accordingly. In case of human or computer error, Maxima Travel or Gutsy Lady Travel reserves the right to re-invoice for the correct price or service. A full refund will be made to passengers who choose not to pay an increase, provided Maxima Travel and/or Gutsy Lady Travel receives a written cancellation within five days of the price increase notification.

Errorneous Pricing
We reserve the right not to honour any published prices that Maxima Travel determine were erroneous due to printing, electronic or clerical error.

Passenger Agreement
All passengers are required to complete a Passenger Agreement prior to travel and, by so doing, formally accept Maxima Travel or Gutsy Lady Travel’s Terms & Conditions. Passenger will be provided a verbal review of the Passenger Agreement which will be delivered via email shortly after the time of booking. Customers who are unable to receive and complete their Passenger Agreement via email may request the Agreement be provided via fax or mail. Travel documents will not be released without a completed Passenger Agreement. Maxima Travel or Gutsy Lady Travel reserves the right to cancel bookings and return deposits without a completed Passenger Agreement. The Passenger Agreement incorporates these Terms & Conditions including Release from Liability, Assumption of Risk and Arbitration Clauses. Completion of the Passenger Agreement constitutes agreement to these Travel Terms & Conditions and Maxima Travel and Gutsy Lady Travel Release from Liability, Assumption of Risk and Compulsory Arbitration Clause.
